YouTuber Retro Games Corp has received a copyright strike merely for showing a Nintendo emulator to his viewers.
The relationship between Nintendo and the fans has always been a bit difficult. Recently, the largest Switch emulator was banned on Nintendo's instructions, and now, a content creator has received a copyright strike for merely showing their fans a Switch emulator.
Nintendo continue waging war on emulators
Retro Games Corp has around 550,000 subscribers on his YouTube channel, to whom he often presents the latest Nintendo emulators. But in a recent upload, he revealed that one of his video about a Wii U emulator had been taken down.
He is apparently trying to fight back, but has announced that he will make his videos differently in future so as not to fall under Nintendo's vengeful gaze again. For example, from now on, he will avoid showing any Nintendo games on screen.
The YouTuber does make one very good argument against the original copyright strike; the Wii U Store is closed, so Nintendo aren't being directly hurt by this particular emulator:
I am still considering a counter claim under fair use, as the video was for educational use, transformative in nature, and had no effect on the market -- it was a demonstration of a console no longer for sale (even the Wii U eShop is closed, so the company itself has no means of earning revenue from Wii U sales).
But however strong his arguments, this is his second strike, so he needs to stop, or his channel will be deleted.
Do you think Nintendo's reaction is fair?
